These Terms and Conditions (“Terms”) govern your purchase, reservation, use, and access to Monako smart glasses, related hardware, software, services, developer tools, and accessories (collectively, the “Monako Products and Services”).
By placing a reservation, paying a deposit, completing an order, purchasing a Monako product, or using Monako software or services, you agree to these Terms.
“Monako,” “we,” “us,” or “our” refers to MonakoAI.
1. About Monako
Monako develops AI-powered smart glasses and related software, hardware, accessories, operating systems, developer tools, and AI services.
Certain Monako products may be offered during development, pre-production, preorder, reservation, early-access, developer-preview, or limited-production stages.
Because Monako is an evolving hardware and software platform, certain specifications, features, interfaces, software capabilities, delivery schedules, and product designs may change during development and manufacturing.
2. Reservations and Preorders
2.1 Reservation Deposit
For certain production batches, Monako may allow customers to reserve a product by paying a reservation deposit.
For the first production batch, eligible customers who successfully paid the USD $19 reservation deposit are considered first-batch reservation holders, subject to these Terms and successful completion of the remaining payment.
The reservation deposit is not, by itself, payment for the full purchase price of the product.
2.2 Final Purchase Price
The announced price for the first production batch of Monako glasses is:
USD $399
Unless otherwise stated during checkout, the applicable reservation deposit will be credited toward the final purchase price.
Taxes, shipping fees, customs duties, import charges, optional prescription lenses, upgrades, accessories, and other applicable charges may be calculated separately.
2.3 Final Payment
Before shipment, Monako may send eligible reservation holders a request to complete their order.
Customers may be required to provide or confirm information including:
- shipping address;
- contact information;
- prescription lens requirements;
- lens configuration;
- applicable taxes and duties;
- selected accessories or upgrades; and
- final payment.
Failure to complete final payment or provide required information within the specified period may delay shipment or result in cancellation of the reservation.
3. Refunds of Reservation Deposits
Unless otherwise expressly stated at the time of purchase, a reservation deposit may be refunded before the customer completes the final purchase payment.
Once the final payment has been completed, the order will become subject to Monako's applicable cancellation, return, and refund policies.
Refunds will generally be returned to the original payment method where technically and legally possible.
Payment processors, banks, card networks, currency conversion providers, or other financial institutions may impose processing times or fees outside Monako's control.
4. Product Development and Specification Changes
Monako is a continuously evolving hardware and software platform.
Between reservation and final production, Monako may modify product components, specifications, materials, suppliers, manufacturing processes, software architecture, firmware, industrial design, or technical implementation where reasonably necessary to improve:
- performance;
- reliability;
- safety;
- manufacturability;
- supply-chain availability;
- power efficiency;
- developer capabilities; or
- overall product quality.
For example, Monako's development process has included migration of the primary computing platform from an earlier Rockchip-based architecture to the Qualcomm AR1 platform.
Such engineering changes may require redesign, validation, testing, certification, firmware adaptation, or manufacturing adjustments and may affect previously estimated schedules.
Monako will make reasonable efforts to ensure that material changes do not substantially reduce the core functionality of the product purchased.
Information published during development—including prototypes, renders, demonstrations, benchmarks, engineering samples, AMA discussions, development roadmaps, or preliminary specifications—should not be interpreted as a guarantee that every demonstrated feature or specification will appear unchanged in the final production product.
5. Estimated Delivery and Production Delays
Any production date, shipping date, delivery window, manufacturing milestone, or estimated timeline communicated by Monako before shipment is an estimate rather than a guaranteed delivery date, unless expressly stated otherwise in writing.
Hardware development and manufacturing may be affected by factors including:
- engineering changes;
- component availability;
- supplier delays;
- tooling;
- certification;
- yield rates;
- quality-control results;
- reliability testing;
- firmware development;
- logistics;
- customs;
- force majeure events; and
- other circumstances outside Monako's reasonable control.
Monako may delay production or shipment when additional engineering, testing, validation, or manufacturing work is reasonably necessary to meet product quality or safety requirements.
A production delay does not automatically constitute a breach of these Terms.
Where a material delay occurs, Monako will make reasonable efforts to communicate significant updates through its official channels.
6. Shipping, Customs, and Import Duties
Monako may ship products internationally to supported countries and regions.
Unless expressly included during checkout, customers are responsible for applicable:
- customs duties;
- import taxes;
- VAT/GST;
- brokerage fees;
- customs clearance charges; and
- other government-imposed charges.
International shipping estimates are not guaranteed and may be affected by customs processing, carriers, regional regulations, holidays, or other circumstances outside Monako's control.
Customers are responsible for providing a complete and accurate delivery address.
Additional costs resulting from incorrect or incomplete customer-provided shipping information may be charged to the customer where permitted by law.
7. Prescription Lenses
Monako may provide optional prescription lens services for supported configurations.
Customers may be asked to provide prescription information including:
- SPH;
- CYL;
- AXIS;
- PD;
- ADD, where applicable; and
- other information reasonably required for lens manufacturing.
Customers are responsible for ensuring that prescription information submitted to Monako is accurate and current.
Prescription lenses are individually manufactured products and may therefore be subject to different cancellation, return, or refund conditions where permitted by applicable law.
Additional charges may apply to certain lens configurations, including progressive or ADD-based prescriptions.
Customers may also choose to obtain compatible prescription lenses from a third-party optical provider where supported.
Monako does not guarantee the quality, compatibility, installation, or performance of lenses manufactured or installed by unaffiliated third parties.
8. Software and MonoOS
Monako glasses may include or support MonoOS, a Linux-based software environment, together with Monako applications, APIs, runtime components, firmware, developer tools, and related software.
Certain parts of the platform may allow advanced users and developers to:
- develop and install applications;
- access supported hardware capabilities;
- interact with cameras, sensors, audio systems, or other hardware;
- access supported AI/NPU capabilities;
- deploy custom software; and
- modify portions of the user software environment.
The exact availability of APIs, hardware interfaces, SDK functionality, system access, or developer capabilities may depend on the applicable software version, hardware revision, security requirements, regulatory requirements, and development status.
Documentation, SDKs, emulators, APIs, developer previews, and experimental features may change over time.
9. Developer and Advanced System Access
Monako is designed to provide developers with substantially more flexibility than a conventional closed consumer-electronics platform.
However, advanced system access involves additional risk.
Installing, executing, modifying, or developing custom software may result in:
- application crashes;
- system instability;
- excessive battery consumption;
- overheating;
- data loss;
- degraded performance;
- privacy or security vulnerabilities;
- loss of functionality; or
- the need to restore or reinstall system software.
Users are responsible for software, scripts, applications, models, agents, configurations, or modifications they install or execute themselves.
Monako may provide recovery mechanisms, software images, reset functionality, developer documentation, or other recovery tools, but does not guarantee recovery from every user-created software failure.
Damage or malfunction caused directly by unauthorized hardware modification, unsupported software modification, malicious software, or use outside documented operating limits may be excluded from warranty coverage to the extent permitted by applicable law.
10. AI Features
Certain Monako features may use artificial intelligence running:
- on the device;
- through connected devices;
- through Monako-operated cloud infrastructure; or
- through third-party AI services selected or configured by the user.
AI-generated results may be incomplete, inaccurate, delayed, or incorrect.
Users should not rely solely on AI-generated information for decisions involving health, safety, legal matters, financial matters, emergency situations, navigation where incorrect information could cause harm, or other high-risk activities.
Monako does not guarantee the accuracy or availability of AI-generated outputs.
Third-party AI providers may be governed by their own terms and privacy policies.
11. Camera, Microphone, Sensors, and Privacy
Monako glasses may contain cameras, microphones, motion sensors, wireless radios, and other sensing capabilities.
Users are responsible for operating these features in accordance with applicable laws and respecting the privacy and rights of others.
Depending on jurisdiction, recording audio, video, images, conversations, workplaces, private property, or individuals without appropriate notice or consent may be restricted or prohibited.
You are responsible for understanding and complying with local laws before using recording or sensing functionality.
Where available, privacy-related hardware or software controls are intended to assist users but do not replace the user's legal responsibilities.
12. Data and Third-Party Services
Certain functionality may require network connectivity or communication with external services.
Depending on the feature used, data may be processed:
- locally on the glasses;
- on a paired device;
- by Monako infrastructure; or
- by third-party services selected or enabled by the user.
The handling of personal information by Monako is governed separately by the Monako Privacy Policy.
Third-party services are governed by their respective terms and privacy policies.
Users installing third-party applications or connecting third-party AI services are responsible for reviewing the data practices of those services.
13. Connectivity and Service Availability
Certain Monako functionality may depend on:
- Wi-Fi;
- Bluetooth;
- internet connectivity;
- smartphones or companion devices;
- third-party APIs;
- cloud AI providers; or
- other external infrastructure.
Monako does not guarantee uninterrupted availability of functionality dependent on third-party networks or services.
Features may temporarily become unavailable because of maintenance, network conditions, API changes, service-provider changes, security requirements, or circumstances outside Monako's control.
14. Battery and Performance
Battery life, AI performance, NPU performance, thermal behavior, wireless performance, display visibility, and other performance characteristics may vary depending on:
- workload;
- screen usage;
- wireless connectivity;
- AI workloads;
- camera usage;
- audio usage;
- installed applications;
- environmental conditions;
- software versions; and
- battery age.
Published battery-life or performance figures represent measurements, engineering targets, or estimates under particular conditions and are not guarantees of identical real-world results.
15. Experimental and Preview Features
Monako may provide features designated as:
Alpha, Beta, Preview, Developer Preview, Experimental, Labs, Early Access, or similar terminology.
These features may:
- contain bugs;
- change without notice;
- have incomplete documentation;
- be temporarily unavailable;
- produce unexpected results; or
- be removed before general release.
Preview features are provided primarily for testing and development and should not be relied upon for mission-critical applications.
16. Acceptable Use
You may not use Monako Products and Services to intentionally:
- violate applicable law;
- infringe intellectual-property rights;
- invade another person's privacy;
- bypass security protections without authorization;
- distribute malware;
- unlawfully access systems or data;
- interfere with Monako infrastructure; or
- use cameras, microphones, sensors, or AI functionality in a manner prohibited by applicable law.
Monako may restrict access to online services where reasonably necessary to address security, abuse, legal, or infrastructure risks.
17. Ownership and Intellectual Property
Monako and its licensors retain all rights in Monako trademarks, branding, industrial designs, proprietary software, documentation, APIs, firmware, and other intellectual property except where expressly licensed otherwise.
Open-source components included in Monako software remain subject to their respective open-source licenses.
Unless otherwise specified, developers retain ownership of applications and original software they independently create using Monako developer tools.
Use of Monako APIs, SDKs, trademarks, or distribution services may be governed by additional developer terms.
18. Warranty
Monako hardware is covered by the warranty expressly provided with the product and any mandatory consumer protections required under applicable law.
The final warranty period and region-specific warranty conditions applicable to your purchase will be presented in the applicable warranty policy.
Unless prohibited by law, warranty coverage may exclude damage caused by:
- accidents;
- misuse;
- unauthorized physical modification;
- liquid exposure beyond the product's rated protection;
- improper charging equipment;
- unauthorized repair;
- unsupported modifications;
- abnormal operating environments; or
- other causes unrelated to manufacturing defects.
Nothing in these Terms limits statutory consumer rights that cannot legally be waived.
19. Returns and Refunds
Return eligibility for completed product purchases will be governed by the Monako Return and Refund Policy applicable to the customer's region and order.
Certain customized products, including prescription lenses or personalized components, may have limited return eligibility where permitted by applicable law.
Nothing in these Terms excludes any mandatory cancellation, refund, return, or consumer-protection right provided by applicable law.
20. Safety
Monako glasses should be used responsibly and with appropriate awareness of your surroundings.
Do not use Monako Products or Services in circumstances where distraction or obstruction of attention could create an unreasonable safety risk.
Users should comply with applicable laws governing wearable displays, cameras, audio devices, wireless devices, driving, cycling, workplace equipment, and similar environments.
Monako Products are not medical devices unless expressly identified and certified as such.
Health, wellness, or sensor-derived information should not be interpreted as medical diagnosis or medical advice.
21. Limitation of Liability
To the maximum extent permitted by applicable law, Monako will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of Monako Products or Services.
This includes, where legally permitted, losses arising from:
- loss of data;
- loss of business;
- loss of profits;
- third-party software;
- AI-generated outputs;
- unsupported system modifications;
- network outages; or
- third-party services.
Nothing in these Terms excludes or limits liability where such limitation is prohibited by applicable law.
22. Force Majeure
Monako will not be responsible for delays or failures caused by circumstances beyond its reasonable control, including natural disasters, war, civil disturbances, epidemics, government actions, regulatory changes, transportation disruptions, labor disputes, component shortages, supplier failures, major network outages, or similar events.
23. Changes to Products and Services
Monako may update software, firmware, services, APIs, developer tools, cloud infrastructure, and other functionality over time.
Updates may introduce, modify, replace, or remove functionality where reasonably necessary for security, compatibility, regulatory compliance, performance, or continued product development.
Where a change materially affects a paid service or core purchased functionality, Monako will comply with applicable consumer-protection requirements.
24. Changes to These Terms
Monako may update these Terms from time to time.
The updated Terms will display a revised “Last Updated” date.
Where required by law, Monako will provide additional notice or obtain consent before material changes become effective.
Changes to these Terms will not retroactively remove mandatory rights applicable to purchases already completed.
25. Governing Law and Dispute Resolution
These Terms are governed by the laws of [Jurisdiction], excluding conflict-of-law principles, except where mandatory consumer law requires otherwise.
Any dispute arising from these Terms or Monako Products and Services will be handled according to the dispute-resolution procedures applicable to the customer's jurisdiction and any mandatory consumer-protection laws.
